The terms and conditions governing your use of HazmatBOL, PlacardPro, and all related services provided by Mile Marker Technologies.
By accessing or using HazmatBOL, PlacardPro, or any related services provided by Mile Marker Technologies ("we," "us," "our"), you agree to be bound by these Terms of Use. If you are using the service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.
If you do not agree to these terms, do not use the service.
HazmatBOL is a mobile and web-based compliance advisory platform for commercial carriers transporting hazardous materials. The service provides:
HazmatBOL is an advisory tool only. It does not replace official DOT/PHMSA regulations, professional hazmat training, certified shipping paper review, or legal and compliance counsel. Results produced by the app are automated and may contain errors. The carrier, shipper, and driver remain solely responsible for compliance with all applicable federal, state, and local regulations.
Specifically:
To use the fleet management console, you must register a carrier account. You agree to provide accurate, current, and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Fleet administrators are responsible for:
Drivers are provisioned by fleet administrators and do not independently register. By provisioning a driver, the fleet administrator represents that the driver has been informed they will receive an SMS activation code and consents to receive messages from HazmatBOL as a condition of their employment or engagement.
Drivers may opt out of SMS messages at any time by replying STOP. See our SMS Terms for details.
Access to the fleet management console and driver provisioning requires a paid subscription at $9.99 per driver seat per month. Billing is processed monthly via Square. You authorize us to charge your payment method on a recurring basis until you cancel.

HazmatBOL, PlacardPro, and all associated software, design, content, and trademarks are the property of Mile Marker Technologies. These Terms do not grant you any ownership rights in the service.
Your scan data (extracted BOL fields, validation results) remains yours. We do not claim ownership of your fleet's compliance records.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that the service will be uninterrupted, error-free, or that defects will be corrected. We do not warrant the accuracy or completeness of any compliance determination made by the application.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MILE MARKER TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO REGULATORY FINES, INSPECTION PENALTIES, LOST PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total liability to you for any claims arising under these terms shall not exceed the amount paid by you to us in the three months preceding the claim.
You agree to indemnify, defend, and hold harmless Mile Marker Technologies and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these terms, or your violation of any applicable law or regulation.
You may cancel your subscription at any time through the fleet console or by contacting us. We may suspend or terminate your account for violation of these terms, non-payment, or fraudulent activity, with notice where reasonably practicable.
Upon termination, your right to access the service ceases. We will retain your scan records for a reasonable period as described in our Privacy Policy.
These Terms are governed by the laws of the State of Mississippi, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of Lafayette County, Mississippi.
We may update these Terms of Use from time to time. Material changes will be communicated to fleet administrators via email with at least 14 days notice before taking effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
